TERMS AND CONDITIONS

By requesting a quote, submitting a custom order request, or interacting with the Rogue Wear website, you agree to be bound by these Terms and Conditions. These terms govern your engagement with us for the provision of custom apparel and the purchase of any non-custom items.

2. Quote & Ordering Process

2.1. Quote Validity

All quotes provided by Rogue Wear are estimates based on the information provided.

  • A quote is valid for 30 days from the date of issue.
  • If the quote is not accepted within this period, Rogue Wear reserves the right to issue a new quote reflecting current costs.

2.2. No Direct Online Sales

Rogue Wear does not process payments or finalize custom sales directly through this Shopify website. This website is for informational and catalogue purposes only. All custom orders are confirmed and finalized after a quote is accepted.

2.3. Order Confirmation

A custom order is only confirmed and binding upon the fulfillment of all the following:

  1. The customer formally accepts the provided quote (typically via written email confirmation).
  2. The customer approves the final digital mock-up or design proof (see Section 3).
  3. Rogue Wear receives Full Payment for the order.

3. Artwork, Proofs, and Production

3.1. Customer Responsibility for Artwork

The customer warrants they have the legal right to use any submitted designs, logos, or artwork, and agrees to indemnify and hold Rogue Wear harmless from any claims, lawsuits, or demands related to copyright or trademark infringement arising from the use of the provided artwork.

3.2. Design Proofs and Approval

  • Rogue Wear will provide a digital design proof (mock-up) for every custom order.
  • The customer must review and approve this proof for accuracy (spelling, color, garment type, and placement).
  • Production will not begin until the customer provides final written approval of the proof.

3.3. Errors After Approval

Rogue Wear is not responsible for errors or discrepancies in the final product that were present in the approved design proof. If the final product matches the approved proof, the customer is responsible for the full cost of the order.

3.4. Production Timeline

The estimated turnaround time will be included in the quote. The timeline begins only after proof approval and receipt of Full Payment.

4. Pricing and Payment

4.1. Payment Terms and Method

Full Payment is required to officially confirm and begin production on any custom order. Payment is accepted via Bank Transfer only. Details for the transfer will be provided in the official quote.

4.2. Cancellations

  • If a custom order is canceled before production begins, the customer may be liable for any costs incurred by Rogue Wear (e.g., design fees).
  • If a custom order is canceled after production has begun, the customer is responsible for the full quoted amount.

5. Product Warranties, Returns, and Refunds

5.1. Custom/Personalized Items

Due to the custom nature of the products, custom or personalized items are non-returnable and non-refundable, except in cases of manufacturing defects.

5.2. Returns for Non-Custom Items

If you are not completely satisfied with your purchase of a non-custom item (such as a stock bag or accessory), you may return it within 30 days of delivery for a refund or exchange. Items must be unused and in original condition with tags attached.

5.3. 5-Year Bag Warranty (Maine-Made Bags)

Our Maine-made bags are built to last and come with a 5-year warranty under normal use and care.

  • If your bag needs repair or replacement, please email sales@roguewear.com with photos and a brief description of the issue.
  • We will evaluate your claim and provide the necessary next steps for repair or replacement.

5.4. Claims for Defects

Any claims for manufacturing defects (on both custom and non-custom items) must be made in writing within 7 days of receiving the order, along with photographic evidence of the defect.

6. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Maine, USA.
